These terms govern your use of Kemboja's website and the advisory services we provide. Please read them carefully before engaging with us.

Definitions

Throughout these Terms, the following definitions apply:

  • "Kemboja", "we", "us", "our" — refers to the residential advisory operating under the name Kemboja at Jalan Kiara 5, Mont Kiara, 50480 Kuala Lumpur.
  • "You", "User", "Client" — any individual accessing this website or engaging our services.
  • "Services" — the residential advisory, tenancy coordination, and related offerings described on this website.
  • "Agreement" — these Terms and Conditions, together with any signed engagement letter or service agreement.
  • "Site" — the website accessible at kembojae.pro.
  • "Content" — all text, images, data, and other material published on the Site.

Acceptance of Terms

By accessing the Site or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use the Site or submit an enquiry.

Our services are available to individuals aged 18 and above who have the legal capacity to enter into a binding agreement under Malaysian law. Submitting our enquiry form constitutes your representation that you meet this requirement.

Service Description

Kemboja provides residential advisory services focused on the Mont Kiara district of Kuala Lumpur. Our principal service offerings are:

  • Residence search and property shortlisting
  • Tenancy coordination, lease review, and handover management
  • Relationship-led advisory for clients seeking upper-tier residences

Services are delivered in English and are intended for clients relocating to or within Kuala Lumpur. We operate during our published business hours and cannot promise continuous availability. All services are subject to property and landlord availability, which lies outside our control.

User Responsibilities

When using our Site or engaging our services, you agree to:

  • Provide accurate, complete, and current information in all communications and enquiries
  • Use the Site only for lawful purposes and in a manner consistent with these Terms
  • Not attempt to access systems, data, or areas of the Site beyond what is publicly available
  • Not reproduce, distribute, or commercially exploit Site Content without written permission
  • Not submit false, misleading, or fraudulent enquiries
  • Notify us promptly if any information you have provided changes materially

We reserve the right to decline a service request where information provided is incomplete or where we determine in good faith that we cannot meet your requirements.

Intellectual Property

All Content on the Site — including text, photographs, graphics, design elements, and building dossiers — is owned by or licensed to Kemboja and is protected under Malaysian intellectual property law.

We grant you a limited, personal, non-commercial licence to access and view the Site for the purpose of evaluating or engaging our services. This licence does not permit you to copy, republish, adapt, or redistribute any Content without prior written consent.

Residence descriptions and building assessments produced by Kemboja as part of our service are prepared for your personal use only and may not be forwarded to third parties without our agreement.

Fees & Payment

Our service fees are quoted in Malaysian Ringgit (RM) and are set out in our current service descriptions. The applicable fee for your engagement will be confirmed in writing before work commences.

  • Payment terms are specified in the engagement letter for each service
  • Fees are due in accordance with the agreed schedule; late payment may result in a pause in service activity
  • All payments are non-refundable once a service has been delivered, unless otherwise agreed in writing
  • Where a tenancy does not proceed through circumstances outside Kemboja's reasonable control, fees already paid for completed service components are retained

We accept payment by bank transfer to our Malaysian account. Details are provided upon engagement confirmation.

Service-Specific Terms

Mont Kiara Residence Search

The search service covers candidate identification, pre-visit assessment, and written impression notes for a mutually agreed shortlist. The scope of the search is defined at engagement; significant changes to requirements after commencement may require a revised scope agreement.

Tenancy Coordination & Resident Liaison

This service covers the steps from lease preparation through move-in, as described in our service summary. We act as coordinator and do not act as a legal representative of either landlord or tenant. We recommend independent legal review of any tenancy agreement before signing.

Signature Mont Kiara Residence Programme

The Signature Programme includes private viewings, building documentation, and concierge coordination as outlined in our service description. Airport reception and household staff introductions are subject to availability and advance scheduling. This service is offered to a limited number of clients at any one time to maintain the quality of attention provided.

Disclaimers

The information on this website is provided for general informational purposes. While we take care to keep property descriptions accurate, rental market conditions in Kuala Lumpur change frequently, and we cannot warrant that all information remains current at the moment of your reading.

Our advisory opinions on building character, management quality, and neighbourhood suitability reflect our team's professional assessments and are offered as informed perspective, not as legal or financial advice. We recommend you conduct your own due diligence before committing to a tenancy agreement.

The Site is provided on an "as available" basis. We do not warrant that the Site will be free of errors or uninterrupted, and we accept no liability for temporary unavailability.

Limitation of Liability

To the fullest extent permitted by Malaysian law, Kemboja's liability for any claim arising from these Terms or from the delivery of our services is limited to the fees paid by you for the specific service to which the claim relates.

We are not liable for indirect, consequential, or special losses, including lost rental opportunities, costs arising from tenancy disputes between landlord and tenant, or any loss arising from circumstances beyond our reasonable control (including property withdrawal by a landlord, regulatory changes, or force majeure events).

Nothing in these Terms limits liability for death, personal injury, or fraud caused by our negligence.

Termination

Either party may terminate a service engagement by written notice. If you choose to discontinue before the service is completed, fees for work already performed are due and payable. If Kemboja terminates for reasons not attributable to your conduct, we will provide a fair and reasonable settlement for any prepaid, unused portion.

We reserve the right to suspend or end your access to the Site if we reasonably believe you are using it in breach of these Terms. The obligations in Sections 5, 8, 9, and 11 survive termination.

Dispute Resolution

These Terms are governed by the laws of Malaysia. Any dispute arising from these Terms or from our services should first be raised with us directly — most concerns are resolved quickly at this stage.

If a dispute cannot be resolved informally within 30 days, either party may refer the matter to mediation under the Malaysian Mediation Act 2012 before commencing court proceedings. Any legal proceedings shall be brought in the courts of Kuala Lumpur, Malaysia.

General Provisions

  • Entire agreement. These Terms, together with any signed engagement letter, constitute the full agreement between you and Kemboja regarding the subject matter.
  • Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
  • Waiver. A failure by either party to enforce a right under these Terms does not constitute a waiver of that right.
  • Assignment. You may not assign your rights or obligations under these Terms without our written consent. We may assign our obligations to a successor entity without restriction.
  • Notices. Formal notices should be directed to the contact details in Section 14. Email notices are deemed received on the next business day.

Changes to These Terms

We may revise these Terms from time to time to reflect changes in our services, applicable law, or best practice. The effective date at the top of this page will be updated accordingly. We will provide notice of material changes on the Site homepage for a reasonable period.

Your continued use of the Site or engagement with our services after a change is posted constitutes your acceptance of the revised Terms.
